Terms of service

Last updated: October 21, 2026

1. About these terms

These Terms of Service govern use of the Break A Plate online store and purchases made through it. “We,” “us,” and “our” refer to Break A Plate. Please read these terms together with our shipping policy, returns and refunds policy, and privacy policy before ordering.

By placing an order, you agree to the terms presented for that purchase. Nothing in these terms removes any consumer protection, cancellation right, warranty, or other remedy that cannot lawfully be excluded.

2. Using the store

You must have the legal capacity to make a purchase, or have authorization from a parent, guardian, or other person who can lawfully authorize it. Provide accurate contact, payment, and delivery information and use a payment method you are authorized to use. If you create an account, keep your login details secure and notify us of unauthorized activity.

Do not use this store for fraud, unlawful activity, infringement of another person’s rights, or attempts to damage or interfere with the website, its security, or its services.

3. Products and quantities

Our breakable celebration plates are made of gypsum and manufactured in China. Plates are sold in boxes of 36, with a minimum order of three boxes (108 plates). Choose the complete package size you need; the volume price applies to the selected package. Product images are illustrative, and colours may appear differently on different screens. This does not affect your rights if goods are faulty or do not match their description.

Use products responsibly and follow any handling instructions supplied with your order. Intentional plate breaking creates fragments; arrange a suitable area, keep bystanders clear, supervise children, and follow your venue’s requirements.

4. Prices, payment, and orders

Prices are in Canadian dollars (CAD), unless checkout expressly states otherwise. Applicable taxes and shipping charges are shown at checkout before payment. International import charges may be collected separately as described below. Payment methods available for your order are displayed at checkout.

Review your selected package, quantity, delivery address, shipping method, and total before submitting an order. We send an order confirmation to the email address you provide. Contact us promptly if any details are incorrect or you need to request a change or cancellation. We will explain whether a change can still be made; any mandatory cancellation rights continue to apply.

If a product becomes unavailable, a payment cannot be processed, or a genuine pricing or description error affects an order, we will contact you promptly to explain the issue. We will not increase an agreed price without your consent. If we cannot fulfil an order, we will refund any payment for the unfulfilled items, including applicable delivery charges. Future price or product changes do not retrospectively change confirmed orders.

5. Shipping, pickup, and delivery

We ship within Canada, to the United States, and internationally where carrier service is available. Enter your address at checkout to see available services, prices, and delivery estimates. Carrier estimates are estimates, and customs processing can affect arrival times. Contact us before ordering for a time-sensitive event.

If no shipping service is available for your order and address, pickup is available. Select Pickup at checkout and wait for a ready-for-pickup notification before collecting. See our shipping policy for full details. Your statutory rights concerning delivery remain unaffected.

6. International duties and taxes

Orders delivered outside Canada may attract import duties, local taxes, brokerage, or customs-clearance fees. Unless checkout expressly states otherwise, these charges are not included in the product price or shipping quote and are payable by the recipient to the carrier or customs authority. Respond promptly to carrier requests for payment or information. Our shipping policy explains these charges.

7. Damage, returns, and refunds

Inspect your order promptly and email breakaplateca@gmail.com, preferably within seven days of delivery, about damage, defects, or incorrect items. Include your order number, photographs of the carton, label, packaging, and affected plates, and the quantity affected. This suggested reporting period does not limit your statutory rights.

For confirmed transit damage, defects, or items sent incorrectly, we arrange an appropriate replacement or refund and cover necessary replacement delivery or return shipping. Do not return broken plates without safe return instructions.

For a change-of-mind return, contact us within 14 days of delivery and return the goods within a further 14 days. Plates must be unused, intact, and securely packaged; the customer pays change-of-mind return shipping. Used or intentionally broken plates are not eligible under this voluntary policy. Refund timing, eligible delivery refunds, return instructions, and mandatory cancellation rights are set out in our returns and refunds policy.

8. Privacy and Shopify

Our store is hosted on Shopify, which provides the commerce platform we use to sell products. Information you submit may be shared with Shopify and service providers, including providers in other countries, to process orders, payments, delivery, support, and other services described in our privacy policy. Shopify also processes information for the purposes described in Shopify’s privacy policy. Depending on your location, you may have rights to opt out of or object to certain processing. See Your privacy choices and Shopify’s privacy portal.

9. Website content and third-party services

Respect the intellectual property rights in this website, including its text, photographs, graphics, and branding. Commercial reproduction requires permission from the relevant rights holder unless permitted by law. Third-party websites and services linked from this store have their own terms and privacy practices. Contact Break A Plate about your purchase; Shopify provides the platform and does not sell you our plates.

10. Responsibility and consumer rights

We are responsible for meeting our obligations under applicable law and the terms of your order. Website interruptions or information errors do not remove those obligations. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that applicable law does not allow us to exclude or limit.

11. Applicable law and changes

These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to any mandatory protections and rights available in your place of residence. Nothing requires you to give up a legal right to bring a claim in a court or forum available to you under mandatory law.

We may update these terms for future use of the store and future orders. The version applicable to your order is the version provided when you placed it, except where law requires otherwise. If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
